This book provides a significant contribution to the literature on land reform in various African contexts. While the economic evidence is clear that secure property rights are a necessary condition for catalysing broad-based economic development, the governance process by which those rights are secured is less clear. This book details the historical complexity of land rights and the importance of understanding this history in the process of trying to improve tenure security. Through a combination of single country case studies, comparative case studies and regional comparisons, the book is unequivocal that good governance is paramount for improving the performance of land reform programmes. All attempts at moving towards more formal secure tenure require congruence with informal norms, beliefs and values, and a set of clear systems and processes to avoid corruption and unintended negative consequences.
Increased global demand for land posits the need for well-designed country-level land policies to protect long-held rights, facilitate land access and address any constraints that land policy may pose for broader growth. While the implementation of land reforms can be a lengthy process, the need to swiftly identify key land policy challenges and devise responses that allow the monitoring of progress, in a way that minimizes conflicts and supports broader development goals, is clear. The Land Governance Assessment Framework (LGAF) makes a substantive contribution to the land sector by providing a quick and innovative tool to monitor land governance at the country level. The LGAF offers a comprehensive diagnostic tool that covers five main areas for policy intervention: Legal and institutional framework; Land use planning, management and taxation; Management of public land; Public provision of land information; and Dispute resolution and conflict management. The LGAF assesses these areas through a set of detailed indicators that are rated on a scale of pre-coded statements (from lack of good governance to good practice). While land governance can be highly technical in nature and tends to be addressed in a partial and sporadic manner, the LGAF posits a tool for a comprehensive assessment, taking into account the broad range of issues that land governance encompasses, while enabling those unfamiliar with land to grasp its full complexity. The LGAF will make it possible for policymakers to make sense of the technical levels of the land sector, benchmark governance, identify areas that require further attention and monitor progress. It is intended to assist countries in prioritizing reforms in the land sector by providing a holistic diagnostic review that can inform policy dialogue in a clear and targeted manner. In addition to presenting the LGAF tool, this book includes detailed case studies on its implementation in five selected countries: Peru, the Kyrgyz Republic, Ethiopia, Indonesia and Tanzania.

Agricultural Land Redistribution and Land Administration in Sub-Saharan Africa: Case Studies of Recent Reforms focuses on “how” to undertake land reforms in Sub-Saharan Africa, but with relevant lessons for other developing countries. It provides details, with case studies, on how reforms were undertaken to address a pressing and controversial development challenge in Africa – land ownership inequality – and an intransigent development issue – inefficiency and corruption in land administration. An equally important contribution of the book is assessing reforms and highlighting valuable lessons for other countries contemplating reforms. The six case studies collectively cover two main areas of land governance: reforms in redistributing agricultural land and reforms in land administration. The first two case studies discuss reforms in redistributing agricultural land in Malawi and South Africa, part of the southern Africa region where land ownership inequalities rival those in Latin America. The remaining case studies, four in number, are focused on addressing corruption and inefficiency in land administration in a variety of contexts of governance including stable and post-conflict countries. The case studies cover: • Decentralizing land administration with demonstrations from Uganda, Ethiopia, Tanzania, and Ghana; • Developing post-conflict land administration systems with examples from Liberia and Rwanda; • Re-engineering and computerizing land information systems with examples from Ghana and Uganda; and • Improving management of government land through land inventories with examples drawn from Ghana and Uganda. The common elements between sometimes disparate experiences provide lessons of relevance to African and other developing countries contemplating similar reforms. The rigorous analysis and yet down-to-earth lessons of experience are a reflection of the authors’ deep global experience underpinned by personal participation in the reforms covered by the book. This volume will be of interest to a wide audience including land specialists and practitioners, African policy makers, experts and managers in the international development community, and the academia.
The land governance assessment framework (LGAF) is an innovative and participatory diagnostic tool that assesses the state of land governance in a country. The LGAF has optional modules for other topics such as large-scale land acquisition, forest land, and regularization of rights in urban areas. In South Africa, large-scale land acquisition was selected as an additional thematic area, as was the case in Nigeria. A framework of approximately 21 land governance indicators guides the process in these thematic areas, each divided into three or four dimensions. In South Africa the LGAF process began in 2011. It was started by the World Bank and implemented by urban landmark. This booklet summarizes the results of the LGAF process in South Africa. Section one gives introduction. Section two contextualizes key issues around land, looking at the history, situation today, and the cadastral system. Section three provides a broad overview of where South Africa is doing well, and where not so well, in terms of land governance issues. Sections 4A to 4F present the LGAF findings for each of the six thematic areas, each starting with performance against the LGAF scorecard for that thematic area, and then discussing key issues. Section five summarizes the findings and main recommendations which emerged during the LGAF process in South Africa. Section six concludes this resource, and suggests some key areas for further examination.

This book is an examination of post-colonial land reforms across various African states. One of the decisive contradictions of colonialism in Africa was the distortion of use, access to and ownership of land. Land related issues and the need for land reform have consistently occupied a unique position in public discourse in Africa. The post-colonial African states have had to embark on concerted efforts at redressing historical grounded land policies and addressing the growing needs of land by the poor. However, agitations for land continue, while evidence of policy gaps abound. In many cases, policy change in terms of land use, distribution and ownership has reinforced inequalities and affected power and social relations in respective post-colonial African countries. Land has assumed major causes of structural violence and impediments to human and rural development in Africa; hence the need for holistic assessment of land reforms in post-colonial African states. The central objective of the text is to identify post-independence and current trends in land reform and to address the grievances in relation to land use, ownership and distribution. The book suggests practicable policy options towards addressing the land hunger and conflict, which could derail the ‘moderate’ socio-economic achievements and political stability recorded by post-colonial African nation-states.
