Department of Labor and Industrial Relations, Division of Workers' Compensation is responsible for working with employers and employees regarding workplace injuries and illnesses. The purpose of workers' compensation insurance is to provide financial assistance to workers injured on the job. The Second Injury Fund supplements workers' compensation benefits paid to injured workers. The fund is likely to be insolvent in 2008 because of changes in Missouri's workers' compensation law that capped the employer surcharge rate at 3 percent.
The objectives of the Oversight Division's evaluation of the Second Injury Fund included reviewing the existence and adequacy of guidelines for claim processing, staffing and efficiencies of the state agencies involved with the Second Injury Fund caseload, existence and adequacy of eligibility guidelines for rehabilitation services, adequacy of service verification before payment, variations between fiscal note projections and actual Second Injury Fund Costs.
The Joint Committee on Legislative Research directed the Oversight Division to perform a program evaluation of the Department of Labor and Industrial Relations, Second Injury Fund to determine and evaluate program performance in accordance with program objectives, responsibilities, and duties as set forth by statute or regulation. That report was issued January 2008. Since that report, other legislative changes and court deceisions warrented an update of the evaluation of the program.
