L'institutionnalisation et l'organisation d'un ordre juridique sur un mode représentatif impliquent un processus de différenciation fonctionnelle entre représentés et représentants permettant la réduction de la multiplicité à l'unité. La personne morale apparaît comme le terme réunificateur de tout système representative. Dans l'ordre international, ce processus est perturbé par la présence, dans les organs intergouvernementaux, de représentants d'Etat qui sont autant d'organes des Etats membres, présence prolongée par le consentement aux actes adoptés en leur sein. Quel en est donc le sujet d'imputation : l'organisation ou ses membres ? Une théorie de l'acte doit être développée au coeur de la théorie de l'organe pour démontrer que l'organisation internationale est la personnification juridique d'une collectivité d'Etats dotée d'un système représentatif, et n'est que cela. La qualité de partie à un traité constitutif et de membre d'une organisation internationale ne prive l'Etat d'aucun des attributs de la souveraineté dans l'ordre international. Au contraire, la faculté d'investir un sujet de droit de compétences nouvelles est précisément un attribut de la souveraineté : l'organisation est tout entière une création des Etats membres. Leur souveraineté n'inhibe pas le processus de personnification de l'organisation qui, en retour, ne la confisque pas : la souveraineté et la relativité des rapports juridiques demeurent les principes régulateurs de l'ordre international.

Judge Shigeru Oda, having served since 1976 in three successive nine-year terms on the International Court of Justice, has helped to shape the Court's jurisprudence for over a quarter century. His influence on the law of the sea spans an even longer period, beginning with his doctoral dissertation at Yale Law school in the 1950s and continuing with his involvement in the First, Second and Third UN Conferences on the Law of the Sea. In a tribute to Judge Oda's significant contributions to international law, leading scholars on the law of the sea, international dispute settlement and the ICJ itself have produced a Festschrift in his honour that promises to be a standard reference work on these topics for years to come. This two volume work, containing over 95 articles, begins by examining the role of the international judge and the jurisdiction of international tribunals (including reservations to jurisdiction, the Optional Clause, the Special Agreement, and the power to indicate special measures). The Liber Amicorum is published on the occasion of the retirement of Professor Božidar Bakotić from the University of Zagreb, Faculty of Law, after an impressive career that started in 1961. His colleagues and former students have contributed to this collection of essays dealing with a variety of topics in the fields of international law which Professor Bakotić himself has been most active in. Therefore, the majority of essays deal with the subjects of international law, the various international régimes of spaces, the international protection of human rights and humanitarian law, the settlement of international disputes and the law of armed conflicts. Notwithstanding the specific international developments over the last twenty years in the geographic area where Professor Bakotić has served (Southeastern Europe), all the authors of the contributions to this Liber Amicorum have dealt with their topics at the level of general international law. The book comprises 32 essays from scholars who had close relations with Professor Bakotić in the course of his career at the Zagreb Faculty of Law, in various other law schools and international organisations, in the International Law Association, in the Croatian Ministry of Foreign Affairs and its Diplomatic Academy. The majority of essays are in English and six are in French.
