Aquí se aborda el problema de los derechos humanos en contextos multiculturales. Se trata de lograr un diálogo intercultural en torno a tan importantes derechos, para lograr acuerdos y cumplirlos lo mejor posible. Para ello, el autor aplica la hermenéutica, que se ha probado como un instrumento útil en el ámbito del multiculturalismo, para lograr una situación de interculturalidad. Concretamente, el autor propone una hermenéutica analógica, que evite un enfoque univocista, en el que la cultura hegemónica se imponga a las más débiles; evita también un abordaje equivocista, en el que las diversas culturas interactúan sin llegar a un consenso que asegure cierta universalidad. En cambio, con un enfoque analógico (la analogía es proporción) se respetarán dentro de lo posible las diferencias entre las culturas en juego, como porciones que se ordenan, procurando alcanzar el consenso necesario para los derechos humanos cuya vocación es la universalidad.
The modern state, law, and constitution result from a legal canon that (re)produces the abyssal lines dividing the world that is validated from the world whose humanity and epistemological validity are denied. This book aims to contribute to a post-abyssal reflection on law and constitutionalism by considering the structural axes of power that are constitutive of modern law “capitalism, colonialism, and heteropatriarchy” alongside the legal plurality of the world. Is it possible to decolonize, decommodify, and depatriarchalize the constitution? The authors speak from multiple geographies, raise different questions, resort to differentiated theoretical approaches, and reveal varying levels of optimism about the possibilities of transforming constitutions. The readers are confronted with critical perspectives on the Eurocentric legal canon, as well as with the recognition of anti-capitalist, anti-colonial, and anti-patriarchal legal experiences. This book explores the interactions of local inhabitants and environmental systems in the Protected Natural Areas of Mexico. Its goal is to help understand how social groups contextualize ecological knowledge, how human activities contribute to modifying the environmental matrix, how cultural and economic aspects influence the use, management and conservation of their ecological environment, and how social phenomena are to be viewed against the backdrop of ecological knowledge. The book reviews the epistemological and historical bases of the socio-ecological relationship, and addresses the evolution of human-natural systems. In Europe and the Americas: Transatlantic Approaches to Human Rights, leading scholars of different disciplines offer new insight into transatlantic approaches to human rights. This book addresses a growing area of concern for scholars and development practitioners: discriminatory gender norms in legally plural settings. Focusing specifically on indigenous women, this book analyses how they, often in alliance with supporters and allies, have sought to improve their access to justice. Development practitioners working in the field of access to justice have tended to conceive indigenous legal systems as either inherently incompatible with women’s rights or, alternatively, they have emphasised customary law’s advantageous features, such as its greater accessibility, familiarity and effectiveness. Against this background – and based on a comparison of six thus far underexplored initiatives of legal and institutional change in Ecuador, Peru, and Bolivia – Anna Barrera Vivero provides a more nuanced, ethnographic, understanding of how women navigate through context-specific constellations of interlegality in their search for justice. In so doing, moreover, her account of ongoing political debates and local struggles for gender justice grounds the elaboration of a comprehensive conceptual framework for understanding the legally plural dynamics involved in the contestation of discriminatory gender norms.
In Neoliberalism from Below—first published in Argentina in 2014—Verónica Gago examines how Latin American neoliberalism is propelled not just from above by international finance, corporations, and government, but also by the activities of migrant workers, vendors, sweatshop workers, and other marginalized groups. Using the massive illegal market La Salada in Buenos Aires as a point of departure, Gago shows how alternative economic practices, such as the sale of counterfeit goods produced in illegal textile factories, resist neoliberalism while simultaneously succumbing to its models of exploitative labor and production. Gago demonstrates how La Salada's economic dynamics mirror those found throughout urban Latin America. In so doing, she provides a new theory of neoliberalism and a nuanced view of the tense mix of calculation and freedom, obedience and resistance, individualism and community, and legality and illegality that fuels the increasingly powerful popular economies of the global South's large cities.
