This book is a study of the forensic theatricality of human rights claims in literary texts about slavery in the sixteenth and the nineteenth century in the Spanish Empire. The book centers on the question: how do literary texts use theatrical, multisensorial strategies to denunciate the violence against enslaved people and make a claim for their rights? The Spanish context is particularly interesting because of its early tradition of human rights thinking in the Salamanca School (especially Bartolomé de Las Casas), developed in relation to slavery and colonialism. Taking its point of departure in forensic aesthetics, the book analyzes five forms of non-narrative theatricality: allegorical, carnivalesque, tragicomic, melodramatic and tragic.

Volume I offers an introductory survey of the phenomenon of genocide. The first five chapters examine its major recurring themes, while the further nineteen are specific case studies. The combination of thematic and empirical approaches illuminates the origins and long history of genocide, its causes, consistent characteristics, and the connections linking various cases from earliest times to the early modern era. The themes examined include the roles of racism, the state, religion, gender prejudice, famine, and climate crises, as well as the role of human decision-making in the causation of genocide. The case studies cover events on four continents, ranging from prehistoric Europe and the Andes to ancient Israel, Mesopotamia, the early Greek world, Rome, Carthage, and the Mediterranean. It continues with the Norman Conquest of England's North, the Crusades, the Mongol Conquests, medieval India and Viet Nam, and a panoramic study of pre-modern China, as well as the Spanish conquests of the Canary Islands, the Caribbean, and Mexico.
Contrary to common assumptions, medieval and early modern writers and poets often addressed the high value of freedom, whether we think of such fable authors as Marie de France or Ulrich Bonerius. Similarly, medieval history knows of numerous struggles by various peoples to maintain their own freedom or political independence. Nevertheless, as this study illustrates, throughout the pre-modern period, the loss of freedom could happen quite easily, affecting high and low (including kings and princes) and there are many literary texts and historical documents that address the problems of imprisonment and even enslavement (Georgius of Hungary, Johann Schiltberger, Hans Ulrich Krafft, etc.). Simultaneously, philosophers and theologians discussed intensively the fundamental question regarding free will (e.g., Augustine) and political freedom (e.g., John of Salisbury). Moreover, quite a large number of major pre-modern poets spent a long time in prison where they composed some of their major works (Boethius, Marco Polo, Charles d'Orléans, Thomas Malory, etc.). This book brings to light a vast range of relevant sources that confirm the existence of this fundamental and impactful discourse on freedom, imprisonment, and enslavement.

This volume tells the story of the interaction between Christianity and law-historically and today, in the traditional heartlands of Christianity and around the globe. This volume presents the first full English translation of four key texts from the dispute between Juan Ginés de Sepúlveda and Bartolomé de las Casas regarding the justice of Spain's invasion of the Americas, culminating in their famous debate in Valladolid in 1550-51. An impassioned defence of the invasion, Sepúlveda's Democrates secundus (composed around 1544) amplified the controversy within Spain about the justice of its activities in the Americas. When Las Casas schemed to block publication of Sepúlveda's manuscript, Sepúlveda wrote an Apologia (1550) in its defence. Tensions were so high that Emperor Charles V called a temporary halt to undertakings in the Americas and convoked a meeting of theologians and jurists in Valladolid to address the matter. Here, Sepúlveda and Las Casas debated bitterly. Las Casas subsequently printed a composite record of the Valladolid deliberations (Aquí se contiene una disputa o controversia, 1552). Sepúlveda retaliated by penning a furious response (Proposiciones temerarias y de mala doctrina, around 1553-54) and strove to have Las Casas' text banned by the Inquisition. The debate between Sepúlveda and Las Casas was a pivotal moment in the history of international legal thought. They argued over fundamental matters of empire and colonial rule; natural law and cultural difference; the jurisdiction of the Church, responsibilities of Christian rulers, and rights of infidel peoples; the just reasons for war and grounds for resistance; and the right to punish idolatry, protect innocents from tyranny, and subjugate unbelievers for the purpose of spreading the Christian faith. With a detailed scholarly introduction that elucidates the complex story of these four controversial texts and reflects on the impacts of Sepúlveda's ideas, which continue to be felt in the theories and practices of war today, this book is a must-read for all those interested in the fields of history, political science, international relations, and colonial studies.
This volume demonstrates that the Catholic rhetoric of tradition disguised both novelties and creative innovations between 1550 and 1700. Innovation in Early Modern Catholicism reveals that the period between 1550 and 1700 emerged as an intellectually vibrant atmosphere, shaped by the tensions between personal creativity and magisterial authority. The essays explore ideas about grace, physical predetermination, freedom, and probabilism in order to show how the rhetoric of innovation and tradition can be better understood. More importantly, contributors illustrate how disintegrated historiographies, which often excluded Catholicism as a source of innovation, can be overcome. Not only were new systems of metaphysics crafted in the early modern period, but so too was a new conceptual language to deal with the pressing problems of human freedom and grace, natural law, and Marian piety.
