Following on from a consultation paper (Consultation paper 174; ISBN 0117302562) published in January 2004, this report contains proposals for reform of the law regarding the termination of a tenancy during its term, by a landlord, due to the tenant having broken the terms of the tenancy agreement. It sets out, in the form of a draft Bill, a new statutory scheme for the termination of tenancies, including a new concept of 'tenant default', to replace the current law of forfeiture. The proposed scheme would define the circumstances in which a landlord may seek to terminate a tenancy early, require the landlord to warn the tenant of the impending action by giving a written notice, and confers enhanced protection on those with interests deriving out of the tenancy. The report is divided into eight parts with three appendices, and issues considered include: problems with the current law of forfeiture of tenancies and the case for reform; the various components of the proposed scheme, including the concept of tenant default and the stages of a landlord's 'termination claim'; and the role of the court.
While there are publications on specific legal fields, no recent book includes several core legal subjects presented in a general manner. Resulting from this need for an updated work on the general principles of law in Hong Kong for use by non-law students and nonlegal professionals, the first edition of this book was published in 2006. After three printings, the latest in 2010, a new edition became necessary to reflect accurately the changes in the law since the first publication. Intended as a practical general guide to the more common legal principles as they relate to Hong Kong -- contract, tort, employment, and property -- the second edition should assist the reader in understanding and anticipating legal issues that might arise in commercial or daily personal situations. Therefore the second edition of this book has been updated to reflect recent court decisions and revisions to Hong Kong ordinances and has been reorganized to render the book more user friendly.
Tenancy law has developed in all EU member states for decades, or even centuries, but constitutes a widely blank space in comparative and European law. This book fills an important gap in the literature by considering the diverse and complex panorama of housing policies, markets and their legal regulation across Europe. Expert contributors argue that that while unification is neither politically desired nor opportune, a European recommendation of best practices including draft rules and default contracts implementing a regulatory equilibrium would be a rewarding step forward.
