This volume contains the proceedings of the conference entitled "Halakhah in Light of Epigraphy" held on 29 May, 2008 under the auspices of the David and Jemima Jeselsohn Center for Epigraphy at Bar-Ilan University. Epigraphic finds, here interpreted broadly to include papyri, scrolls, and the like, have immeasurably enriched our knowledge of the ancient Jewish past while at the same time posing a challenge to modern scholarship: how does one integrate old knowledge, based on previously known sources, with new information? We now recognize that Rabbinic texts are normative: they tell us how their authors believed life should be lived, rather than the details of ordinary, everyday, experience. What weight, then, should be given to traditional halakhic texts in evaluating the contents of newly discovered written remains? And what light can be shed by these new finds, especially those inscriptions and documents that record small moments of ancient Jewish life, upon the long-familiar normative texts? The conference on Halakhah in Light of Epigraphy was intended to generate discussion on these broad issues, as well as to provide a forum for exploration of specific matters of Halakhah reflected in the epigraphic sources. The papers in this volume tend to emphasize the centrality of Halakhah in ancient Judaism. The first section of the volume is devoted to Halakhah in the Dead Sea Scrolls, with contributions by Moshe Benovitz, Vered Noam, Eyal Regev, Lawrence Schiffman, and Aharon Shemesh. These papers examine diversity in halakhic positions, in terms of both exegesis and practice (e.g., festival rituals, dietary laws, and sexual relationships), exploring evidence of halakhic development over the course of the Second Temple period, and halakhic variety among different groups. The second section relates to quotidian documents, and contains Hanan Eshel's survey of the legal documents found in the refuge caves; Steven Fraade's examination of the parnas; Shamma Friedman's analysis of the Jewish bill of divorce; and David Goodblatt's discussion of dating formulae. The final section of the volume examines a variety of epigraphic sources, and includes the following articles: Yonatan Adler on tefillin; Chaim Ben David on synagogue inscriptions; Tal Ilan on burial practices; Ze'ev Safrai and Hannah Safrai on an early Christian text; and Guy Stiebel on food at Masada.
This volume brings together a set of classic essays on early rabbinic history and culture, seven of which have been translated into English especially for this publication. The studies are presented in three sections according to theme: (1) sources, methods and meaning; (2) tradition and self-invention; and (3) rabbinic contexts. The first section contains essays that made a pioneering contribution to the identification of sources for the historical and cultural study of the rabbinic period, articulated methodologies for the study of rabbinic history and culture, or addressed historical topics that continue to engage scholars to the present day. The second section contains pioneering contributions to our understanding of the culture of the sages whose sources we deploy for the purposes of historical reconstruction, contributions which grappled with the riddle and rhythm of the rabbis’ emergence to authority, or pierced the veil of their self-presentation. The essays in the third section made contributions of fundamental importance to our understanding of the broader cultural contexts of rabbinic sources, identified patterns of rabbinic participation in prevailing cultural systems, or sought to define with greater precision the social location of the rabbinic class within Jewish society of late antiquity. The volume is introduced by a new essay from the editor, summarizing the field and contextualizing the reprinted papers. In Torah Praxis after 70 CE, Oliver challenges conventional views of the Gospels of Matthew and Luke as well as the Acts of the Apostles. He reads the works not only against their Jewish “background” but also as early Jewish literature. In doing so, he questions the traditional classification of Luke-Acts as a “Greek” or Gentile-Christian text. To support his assertions, Dr. Oliver’s literary-historical investigation explores the question of Torah praxis in each book, citing evidence that suggests several ritual Jewish practices remained fixtures in the Jesus movement and that Jewish followers of Jesus played key roles in forming the ekklesia well into the first century CE.
This book examines the origins of communal and institutional almsgiving in rabbinic Judaism. It undertakes a close reading of foundational rabbinic texts (Mishnah, Tosefta, Tannaitic Midrashim) and places their discourses on organized giving in their second to third century CE contexts. Gregg E. Gardner finds that Tannaim promoted giving through the soup kitchen (tamhui) and charity fund (quppa), which enabled anonymous and collective support for the poor. This protected the dignity of the poor and provided an alternative to begging, which benefited the community as a whole - poor and non-poor alike. By contrast, later Jewish and Christian writings (from the fourth to fifth centuries) would see organized charity as a means to promote their own religious authority. This book contributes to the study of Jews and Judaism, history of religions, biblical studies, and ethics.

The Cambridge Companion to Judaism and Law explores the Jewish conception of law as an essential component of the divine-human relationship from biblical to modern times, as well as resistance to this conceptualization. It also traces the political, social, intellectual, and cultural circumstances that spawned competing Jewish approaches to its own 'divine' law and the 'non-divine' law of others, including that of the modern, secular state of Israel. This book brings together leading experts in the field of ancient synagogue studies to discuss the current issues and emerging trends in the study of synagogues in ancient Palestine. Divided into four thematic units, the different contributions apply archaeological, textual, historical and art historical methodologies to questions related to ancient synagogues. Part One addresses issues related to the origins and early development of synagogues up to 200 CE. The contributions provide different explanations to the alleged lack of evidence for synagogues built in the second and third centuries CE and ask how much continuity or change there is between the late Second Temple and late Roman/early Byzantine synagogues. Part Two deals with architecture and dating of ancient synagogues. It gives an overview of all synagogues found so far, approaches the dating of Galilean synagogues in the light of the recently-exposed synagogue at Huqoq, and provides a stylistic re-evaluation of the Capernaum synagogue decoration. Part three examines leadership, power and daily life in late antique synagogue contexts, illustrating non-monumental inscriptions, amulets and dining in synagogue contexts as well as the role of individual benefactors. Section four contextualizes synagogue art. An overview of synagogue mosaics in late antique Palestine is complemented with reinterpretations of the mosaics two synagogues. The section also offers a discussion of the appearance of the menorah.
This monograph studies ancient tefillin (also known as phylacteries) and mezuzot found in the Caves of Qumran. Most of these miniature texts were published by the end of 1970s and thus have long been available to scholars. And yet in several respects, these tiny fragments remain an unfinished business. A close scrutiny of their editions reveals a presence of texts that have not been fully accounted for. These fall into three categories. First, there are multiple tefillin and mezuzot that contain legible fragments which their editors were unable to identify. Second, several tefillin and mezuzot feature imprints of letters that have not been deciphered. Third, there are texts which were provisionally classified as tefillin and mezuzot yet left unread. This monograph offers a detailed study of these unidentified and undeciphered texts. It thus sheds new light on the contents of ancient tefillin and mezuzot and on the scribal practices involved in their preparation.
