At a time when nearly all armed conflicts are related to self-determination, and frequently to claims for secession, this meticulous study examines the legal issues at stake in the light of the existence of European micro-States: Liechtenstein, San Marino, Monaco, Andorra and the Vatican City. Jorri Duursma makes a thorough analysis of the true origins, meaning and faults of the modern right of self-determination, asking fundamental questions: What constitutes a people with a right to self-determination? How small a people has this right? Who are allowed to secede? What is a state according to international law? Conventional wisdom among policymakers in both the US and Europe holds that weak and failing states are the source of the world's most pressing security threats today. However, as this book shows, our assumptions about the threats posed by failed and failing states are based on false premises.
This book assesses whether a new category of actors-religious actors-has been constructed within international law. Religious actors, through their interpretations of the religion(s) they are associated with, uphold and promote, or indeed may transform, potentially oppressive structures or discriminatory patterns. This study moves beyond the concern that religious texts and practices may be incompatible with international law, to provide an innovative analysis of how religious actors themselves are accountable under international law for the interpretations they choose to put forward. The book defines religious actors as comprising religious states, international organizations, and non-state entities that assume the role of interpreting religion and so claim a 'special' legitimacy anchored in tradition or charisma. Cutting across the state / non-state divide, this definition allows the full remit of religious bodies to be investigated. It analyses the crucial question of whether religious actors do in fact operate under different international legal norms to non-religious states, international organizations, or companies. To that end, the Holy See-Vatican, the Organization of Islamic Cooperation, and churches and religious organizations under the European Convention on Human Rights regime are examined in detail as case studies. The study ultimately establishes that religious actors cannot be seen to form an autonomous legal category under international law: they do not enjoy special or exclusive rights, nor incur lesser obligations, when compared to their respective non-religious peers. Going forward, it concludes that a process of two-sided legitimation may be at stake: religious actors will need to provide evidence for the legality of their religious interpretations to strengthen their legitimacy, and international law itself may benefit from religious actors fostering its legitimacy in different cultural contexts.

Agency, Security and Governance of Small States examines what seems to be a defining paradox of Small-State Studies: the simultaneous coexistence (and possible co-dependence) of vulnerability and opportunity related to small-state size. This book analyses small states within the framework of this apparent paradox. Traditionally, Small-State Studies has focused on three guiding questions: what constitutes a ‘small state’? What explains small-state influence in global affairs? Are small states truly vulnerable to security threats given the expansion of multilateralism and regionalism throughout the world? This book contends that new questions should be asked which recognise the important shifts in twenty-first century security paradigms, to better understand how some states deploy their smallness as a resource for agency in supranational contexts. By varying historical, geographical, security, and governance contexts, the book embraces a most-different-cases approach. The historical perspective is often neglected in Small-State Studies but contributes to understanding how small states have often, over time, transformed perceived insecurity into agency. By focusing on different world regions, the authors enable the comparative analysis of collective actions, and the creation and implementation of institutions for ‘common sense purposes’ within a geographical region. Of particular contemporary importance, the book includes contributions which contend with hard-security issues alongside other soft-security challenges. The comparison of case studies confirms that hard-security vulnerability and soft-security opportunities seem to be two sides of the same coin, which reinforces the book’s focus on small-state paradoxes, and raises the question of whether smallness can be considered the defining characteristic of governance in these countries. This book will have a broad appeal because of the different world regions it analyses. It will be of interest to postgraduate students, scholars, and researchers of international relations, security, sustainability, governance, development, and political economy, as well as Small-State Studies. Why are small states statistically more likely to have a democratic political system? By addressing this question from a qualitative and comparative methodological angle, this book analyses the effects of a small population size on political competition and participation. By comparing the four microstates of San Marino (Europe), St. Kitts and Nevis (Caribbean), Seychelles (Africa), and Palau (Oceania), it provides fresh and stimulating insight, concluding that the political dynamics of microstates are not as democratic as commonly believed. Instead, it is found in all four cases that smallness results in personalistic politics, dominance of the political executive, patron-client relations between citizens and politicians, and the circumvention of formal political institutions. In addition, the book suggests that the study of formal institutions provides an incomplete image of microstate democracy and that informal characteristics of politics in microstates also need to be explored in order to better explain the influence of smallness on democracy. This book will be of key interest to scholars and students of democracy, democratization, regional and decentralization studies and comparative politics.

The United Nations began as an alliance during World War II. Eventually, however, the UN came to approximate a universal organization - i.e., open to and aspiring to include all States. This presents a legal question, for Article 4 of the Charter contains substantive criteria to limit admission of States to the UN and no formal amendment has touched that part of the Charter. This book gives an up-to-date account of admission to the UN, from the 1950s ‘logjam’ through on-going controversies like Kosovo and Taiwan. With reference to Charter law, the book considers how Article 4 came to accommodate universality and what the future of a universal organization in a world of politically diverse States might be.
"A Theory of Disfunctionality: The European Micro-states as Disfunctional States in the International System" explains the continuing survival of European micro-states as members of the international system. Micro-states are small sovereign states with populations of 1 million or less, of which there are 10 in Europe. The existence of micro-states raises a number of questions about the nature of statehood, the recognition of sovereignty, and the ability of such states to maintain a presence in international politics. This book establishes the ‘theory of disfunctionality’ in which a functional account of statehood is proposed. It is argued that the state has six functions—but the micro-states are so small that they ‘contract out’ some state functions to others in the international system. By doing this, the micro-states ensure their continuing survival in international politics. The book, which focuses on two case studies—Monaco and Luxembourg—, will be of particular interest to those involved in small state studies including scholars, students, practitioners and policy-makers, as well as those researching International Relations and state theory.
