No other European laws are so frequently violated as environmental directives. It challenges the assumption that non-compliance is merely a southern problem. From its antecedents in the 1950s, successive forms of European integration were intended to be leaderless. They have succeeded only too well in demonstrating that much can be achieved without sustained leadership. The attachment to national sovereignty of most of the European elites and mass populations has meant that confederalism has been implicitly accepted for the foreseeable future. This book attempts to clarify three clusters of issues. First, as European integration has advanced, who has provided the impetus? Particular insiders have episodically exerted decisive innovative influence, despite the need to conciliate the jealous champions of national sovereignty. Three case studies are offered: economic and monetary policy, environmental policy and technology policy. The second part examines why the European Union is currently leaderless. The weakened Commission and the increasingly assertive European Council and Council of Ministers have contended for control of agenda-setting but it is in the sphere of foreign and security policy that the EU's logic of leaderlessness has been most conspicuous. Finally, reduced capacity of the Franco-German tandem to offer acceptable leadership and British incapacity to join or replace them in providing overall leadership is also discussed.
Pioneers, Leaders and Followers in Multilevel and Polycentric Climate Governance focuses on pioneers, leaders and followers as central drivers for international climate change governance innovations. A burgeoning literature has identified pioneers and leaders as central drivers for international climate change governance innovations. A wide range of actors (such as international organisations, the European Union, NGOs, corporations and cities) have been identified as potential and actual climate pioneers and/or leaders. Despite this, much of the academic debate is still largely focused on states. To address this research gap, this volume focuses primarily on non-state actors in different multilevel and polycentric governance structures. The chapters offer a critical analysis of the different types of actors (e.g. the EU, corporate actors, NGOs and cities) who can act as pioneers and/or leaders at different levels of climate governance (including the international, supranational, regional, national and local) encompassing non-state and state actors. The volume provides a clear conceptualisation of pioneers, leaders and followers while assessing their motives, capacities, styles and strategies. It examines critically the dynamic interrelationship between leaders and pioneers on the one hand, and followers and laggards on the other. Moreover, it analyses how multilevel and polycentric climate governance structures enable and/or constrain climate pioneers, leaders and followers. This volume will be of great use to scholars of environmental governance, climate change, and international governance. Why Noncompliance traces the history of noncompliance within the European Union (EU), focusing on which states continuously do or do not follow EU Law, why, and how that affects the governance in the EU and beyond. In exploring the EU's long and varied history of noncompliance, Tanja A. Börzel takes a close look at the diverse groups of noncompliant states throughout the EU's existence. Why do states that are vocally critical of the EU have a better record of compliance than those that support the EU? Why has noncompliance been declining since the 1990s, even though the EU was adding member-states and numerous laws? Börzel debunks conventional wisdoms in EU compliance research, showing that noncompliance in the EU is not caused by the new Central and Eastern European member states, nor by the Eurosceptic member states. So why do these states take the brunt of Europe's misplaced ire? Why Noncompliance introduces politicization as an explanatory factor that has been long overlooked in the literature and scholarship surrounding the European Union. Börzel argues that political controversy combined with voting power and administrative capacity, explains why noncompliance with EU law has been declining since the completion of the Single Market, cannot be blamed on the EU's Central and Easter European member states, and is concentrated in areas where EU seeks to protect citizen rights. This book offers a rigorous empirical and theoretical analysis of the implementation of EU legislation and its effect in the wake of the accession of ten new member states to the EU in 2004. The authors offer in-depth empirical case studies of three of the most significant pieces of EU social legislation: the Working Time Directive, the Equal Treatment Directive and the Employment Equality Directive.
The high voting threshold in the Council together with conflicting national preferences should frustrate effective European problem-solving. This famous prediction of the "joint-decision trap" (JDT) is at odds with Europe's dynamic environmental policy. Yet there is scarce research on the limited impact of the JDT in this realm. We know little, therefore, about the conditions of effective environmental policy-change in the EU. By comparing cases of stability and change, including CO2-limits for passenger cars and the phase-out of incandescent lamps, The EU's Green Dynamism examines the ways in and out of the JDT in environmental policy. It shows how both the highly politicized summit level and the bureaucratic "comitology" facilitate change by acting as informal bypasses to the Council. This book contributes to a better understanding of the JDT. It speaks to the recent debate about Europe's "new intergovernmentalism" and the reliance on "informal politics," especially in the wake of the Euro crisis.
