This book engages with and advances the current debate on new governance by providing a much-needed analysis of its relationship with the courts. New modes of governance have produced a plethora of instruments and actors at various levels that present a challenge to more traditional forms of command-and-control regulation. In this respect, it is commonly maintained that new governance generally – and political experimentation more broadly – weakens the power of the courts, producing a legitimacy problem for new forms of governance and, perhaps more fundamentally, for law itself. Focusing on the European Union, this book offers a new account of the role of the courts in new governance. Connecting new governance with the conception of deliberative democracy, this book demonstrates how the role of courts has been transformed by the legal and political experimentation currently taking place in the European Union. Drawing on a series of case studies, it is argued that, although deliberations in governance frameworks provide little by way of hard, binding law, these collaborative frameworks nevertheless condition judicial decision making. With far-reaching implications for how we understand the justiciability of ‘soft law’, participation rights, the legitimacy of governance measures, and the role of courts beyond the nation-state, this book argues that, far from undermining the power of the courts, governance regimes assist their functioning. Its analysis will therefore be of considerable interest for lawyers, political scientists and anyone interested in the transformation of the judiciary in the era of new governance.
Updated since the decision to begin Turkey's admission to the European Union. Turkey is a country in a state of flux, swept along by an extraordinary process of change. In the last few years, a series of far-reaching political and economic reforms has swept away much of the old order which ruled the country for so long. Some people call it a second Turkish revolution. But resistance to reform remains strong. Pressure for change has come from ordinary people fed up with the old ways; it's also been motivated by the dominant issue of Turkish political life - the long pursuit of membership of the European Union. And yet Turkey remains a mystery to many outsiders; a complex country hard to understand. It's secular and Muslim, Western and Eastern, democratic and authoritarian, all at the same time. This book examines the potential and the problems of the new Turkey, and the expectations of the people who live there, drawing on first-hand interviews and observations gathered over several years.
This book examines how gay place-making challenged the juggernaut of neoliberal urbanization in the Malate district of Manila. In this ethnography, Collins explores the creation of place, characterized by neighborhood renewal, gay community and entrepreneurialism, and informal gay sexual labor. Malate teaches us that the power of sexual community to sustain a transgressive, inclusive, gay neighborhood is circumscribed and fleeting, and that urban livability, justice, and freedom must be pursued through organized grassroots political projects if the magic of Malate is to be revived for all its residents.
At a time when American higher education seems ever more to be reflecting on its purpose and potential, we are more inclined than ever to look to its history for context and inspiration. But that history only helps, Paul H. Mattingly argues, if it’s seen as something more than a linear progress through time. With American Academic Cultures, he offers a different type of history of American higher learning, showing how its current state is the product of different, varied generational cultures, each grounded in its own moment in time and driven by historically distinct values that generated specific problems and responses. Mattingly sketches out seven broad generational cultures: evangelical, Jeffersonian, republican/nondenominational, industrially driven, progressively pragmatic, internationally minded, and the current corporate model. What we see through his close analysis of each of these cultures in their historical moments is that the politics of higher education, both inside and outside institutions, are ultimately driven by the dominant culture of the time. By looking at the history of higher education in this new way, Mattingly opens our eyes to our own moment, and the part its culture plays in generating its politics and promise.

Hard Realities presents ideology and strategies for Indian pre-eminence. Some of the interesting takeaways are:– Irrefutably, Pakistan’s existence is not in India’s interest. The time is ripe for dismantling Pakistan as India’s neighbor. Thus, Baluchistan, Sindh, West Punjab, and Kashmir must spin out of Pakistan in different ways, while the Federally Administered Tribal Areas (FATA) must be legitimately returned to Afghanistan. Consequently, India has no choice but to prepare its forces with a sense of urgency for the upcoming world economic disruption in the 2020s. However, India has shortcomings, such as historical failures by the Indian leaders to strategize properly with respect to Pakistan and China; deficient investment in engineering disciplines, and failure to boost its economy timely through indigenous defense production. Mostly, India’s personality is inappreciable. Moreover, India’s approach to China must be unambiguous that Tibet and Xinjiang are not a part of China. As such, India will not share a border with China. But, at present, China is running circles around India, and only technological development of high quality engineering talent will help India. India has a majorly tough row to hoe as a nation. Its 2.5 to 3-front war is its own creation. Though the destiny of nations is a potent force, India must not be found wanting when it comes to singly defending its military and economic independence.
