El estudio se divide en dos partes: en la primera, se analiza la regulación del Registro, tanto en lo que se refiere a la inscripción de formularios como en lo que se refiere a la inscripción de sentencias judiciales que declaran como abusivas determinadas cláusulas de los contratos de adhesión; en la segunda, se analiza en profundidad la cuestión de la inscripción de sentencias judiciales, a la luz de los cambios procesales introducidos por la Ley 1/2000, de 7 de enero, de Enjuiciamiento Civil, y por medio del análisis de determinados casos que la jurisprudencia del Tribunal Supremo (Sala Primera) ha resuelto en los últimos años, especialmente en el ámbito de la contratación bancaria. En esta segunda parte del estudio, el objetivo principal consiste en reflexionar acerca de cómo se relacionan los posibles efectos ultra partes, erga omnes y la inscripción de sentencias en el Registro con aquellas acciones judiciales cuya resolución se basa en el doble control de transparencia de los elementos esenciales de un contrato. Tanto la nueva regulación procesal como este doble control de transparencia, que parece estar mutando hacia un control subjetivo, dificultan y ponen aún más en cuestión la utilidad del Registro y la efectividad del pretendido efecto ultra partes.
