This book gathers together contributions from thirty-two former and current professors who have, through their teaching in the Legal Studies Department at the College of Europe, enhanced the College's reputation as an authentic European academic postgraduate centre of excellence. Within their areas of specialisation the authors analyse both the evolution of European law over the years and more specific questions. The contributions cover institutional/constitutional law, judicial remedies, the law governing the internal market and its accompanying politics, competition law, and the law of the Union's external relations. While the discussions among Brexiters mainly focus on the referendum of 2016 or David Cameron’s “great miscalculation” and its repercussions, this book looks at the Brexit as a process that began decades earlier. It analyses EU-UK relations from a new perspective, taking into consideration the historical background, political aspects, and legal and economic matters. The book provides a holistic understanding of the Brexit, approaching the referendum and its outcomes as the culmination of a long process rather than an isolated political event crafted within the corridors of Westminster or Downing Street 10. Accordingly, it addresses a range of thematic issues, historical patterns of political and economic behavior both within and beyond the United Kingdom, and possible future effects on relations between the Union and one of its most important members.
This book explores the external dimension of the ambitious EU policy on human trafficking. Through this policy the EU institutions and Member States promote the eradication of human trafficking and support, to that end, cooperation with their partners, being third States or international organisations. Analysing the unilateral and multilateral mechanisms the EU uses to achieve these aims, the book questions whether the EU's external response to human trafficking addresses it in all its dimensions, and whether it does so in a coherent way. As a case study, the book explores the cooperation of the EU with countries of the Western Balkans, which constitutes a specific unilateral mechanism. The analysis of the multilateral mechanisms covers the cooperation of the EU with key international and regional organisations combating human trafficking, including but not limited to the Council of Europe or the United Nations Office on Drugs and Crime. The book also examines the impact of the evolution of migration flows and the increasing reliance of military tools on the EU's response to human trafficking.
Since the 1960s, the nature and the future of the European Union have been defined in legal terms. Yet, we are still in need of an explanation as to how this entanglement between law and EU polity-building emerged and how it was maintained over time. While most of the literature offers a disembodied account of European legal integration, Brokering Europe reveals the multifaceted roles Euro-lawyers have played in EU polity, notably beyond the litigation arena. In particular, the book points at select transnational groups of multipositioned legal entrepreneurs which have been in a situation to elevate the role of law in all sorts of EU venues. In doing so, it draws from a new set of intellectual resources (field theory) and empirical strategies only very recently mobilized for the study of the EU. Grounded on an extensive historical investigation, Brokering Europe provides a revised narrative of the 'constitutionalization of Europe'.
Le présent ouvrage est le résultat d’une recherche conjointe entre les Universités de Bologne, Rennes et Bruxelles sur le thème de la dimension extérieure de l’espace de liberté, de sécurité et de justice de l’Union européenne (ELSJ). Cette recherche a été soutenue par la Commission européenne dans le cadre de l’ Action Jean Monnet. Il associe des professeurs et chercheurs de renom qui conjuguent leurs compétences et situent leur analyse à l’intersection des politiques en la matière et des politiques externes de l’Union européenne. Les auteurs évaluent de manière critique l’impact du traité de Lisbonne et de la pratique de l’Union concernant la dimension extérieure de l’ELSJ. Cette dimension dont l’importance ne cesse de croître oblige l’Union à concilier des impératifs parfois contradictoires entre les objectifs sécuritaires de l’ELSJ ou ceux de l’action extérieure, ou encore avec les valeurs sur lesquelles elle est fondée. Les auteurs tentent de répondre à différentes questions induites par le nouveau système de représentation extérieure de l’Union dans le domaine de l’ELSJ : Quelles sont les retombées juridiques du nouveau système ? Quel est également son impact politique ? Ne risque-t-on pas une incursion croissante de la politique étrangère et de sécurité commune (PESC) dans les aspects sécuritaires de l’ELSJ ?
Could regional integration be a first step toward joining the global market? In a context where liberalizing trade has not produced the expected gains in developing countries and growth in global trade has not led to the expected economic growth, an alternative solution has emerged. This new paradigm suggests that trade liberalization should be accompanied by public investment. However, by its very nature, trade liberalization leads to a reduction in revenues from duties and taxes, which means that the available resources for public investments will also be reduced. There are now solid arguments for encouraging the less-developed countries to first emphasize regional integration before trying to access the global market. This book explores the issues linked to regional integration in West Africa and presents empirical data about the experiences in = West African Economic and Monetary Union (WAEMU) countries to converge their economies. It also examines how these efforts, which make a major contribution to regional integration, influence poverty reduction in the economic and monetary community.
