Are lawyers, by their very nature, agents of the state, of capital, of institutions of power? Or are there ways in which they can work constructively or transformatively for the disempowered, the working class, the underprivileged? Lawyers in a Postmodern World explores how lawyers actively create the forms of power which they and others deploy. Through engaging case studies, the book examines how lawyers work within and for powerful institutions and provides suggestions--both general and practical--for ways in which the practice of law can be made to work with and for the powerless. Individuals chapters address such subjects as the contradictions of radical law practice; legal work in South Africa; the economics and politics of negotiating justice; feminist legal scholarship and women's gendered lives; the overlapping worlds of law, business, and politics; theories of legal practice; and how lawyers are constitutive of gender relations. The author discusses how religious groups, especially Jews, Mormons and Jesuits, were labeled as foreign and constructed as political, moral and national threats in Scandinavia in different periods between c. 1790 and 1960. Key questions are who articulated such opinions, how was the threat depicted, and to what extent did it influence state policies towards these groups. A special focus is given to Norway, because the Constitution of 1814 included a ban against Jews (repelled in 1851) and Jesuits (repelled in 1956), and because Mormons were denied the status of a legal religion until freedom of religion was codified in the Constitution in 1964. The author emphasizes how the construction of religious minorities as perils of society influenced the definition of national identities in all Scandinavia, from the late 18th Century until well after WWII. The argument is that Jews, Mormons and Jesuits all were constructed as "anti-citizens", as opposites of what it meant to be "good" citizens of the nation. The discourse that framed the need for national protection against foreign religious groups was transboundary. Consequently, transnational stereotypes contributed significantly in defining national identities.
From different perspectives this book studies the role of Reformation theology in the shaping of Danish society and the social dimensions of Lutheran confessional culture. The book develops an approach making it possible to draw strong conclusion about the social teaching of Luther and its impact on the development of the Danish society. It works on a conceptual level by analyzing the social dimensions of key Lutheran concepts and their translation into the doctrine of the three estates (church, household, and state), and on the level of lived experience of life within these three orders, not at least within the household forming the ideal form also for church and state. Thus the chapters in the book endeavor to connect the social ideas inherent in the Lutheran confession with the social formation of the Danish state from the Reformation into the period of Absolutism. A long mono-confessional situation within the Danish Monarchy makes it possible to study the impact of Lutheranism and the development of a confessional culture within a uniquely long timeframe. The focus is on basic mediums for the translation of Lutheran ideas into social practice: law, primarily connected to marriage and family; and the role of household, both as primary social relations and as basic social and political model. In this way the book offers important insights for theologians, historians, sociologists, and academically anyone interested in the relation between theology and sociality, confession and culture.
