In the years between 1750 and 1868, English criminal justice underwent significant changes. The two most crucial developments were the gradual establishment of an organised, regular police, and the emergence of new secondary punishments, following the restriction in the scope of the death penalty. In place of an ill-paid parish constabulary, functioning largely through a system of rewards and common informers, professional police institutions were given the task of executing a speedy and systematic enforcement of the criminal law. In lieu of the severe and capriciously-administered capital laws, a penalty structure based on a proportionality between the gravity of crimes and the severity of punishments was erected as arguably a more effective deterrent of crime. This book, first published in 1981, examines the impact of these two important developments and casts new light on the way in which law enforcement evolved during the nineteenth century. Through detailed studies of what the courts actually did, Peter King argues that parliament and the Westminster courts played a less important role in the process of law making than is usually assumed. Justice was often remade from the margins by magistrates, judges and others at the local level. Modern criminal courts are characteristically the domain of lawyers, with trials conducted in an environment of formality and solemnity, where facts are found and legal rules are impartially applied to administer justice. Recent historical scholarship has shown that in England lawyers only began to appear in ordinary criminal trials during the eighteenth century, however, and earlier trials often took place in an atmosphere of noise and disorder, where the behaviour of the crowd - significant body language, meaningful looks, and audible comment - could influence decisively the decisions of jurors and judges. This collection of essays considers this transition from early scenes of popular participation to the much more orderly and professional legal proceedings typical of the nineteenth century, and links this with another important shift, the mushroom growth of popular news and comment about trials and punishments which occurred from the later seventeenth century. It hypothesizes that the popular participation which had been a feature of courtroom proceedings before the mid-eighteenth century was not stifled by ’lawyerization’, but rather partly relocated to the ’public sphere’ of the press, partly because of some changes connected with the work of the lawyers. Ranging from the early 1700s to the mid-nineteenth century, and taking account of criminal justice proceedings in Scotland, as well as England, the essays consider whether pamphlets, newspapers, ballads and crime fiction provided material for critical perceptions of criminal justice proceedings, or alternatively helped to convey the official ’majesty’ intended to legitimize the law. Nineteenth-Century Female Poisoners investigates the Essex poisoning trials of 1846 to 1851 where three women were charged with using arsenic to kill children, their husbands and brothers. Using newspapers, archival sources (including petitions and witness depositions), and records from parliamentary debates, the focus is not on whether the women were guilty or innocent, but rather on what English society during this period made of their trials and what stereotypes and stock-stories were used to describe women who used arsenic to kill. All three women were initially presented as 'bad' women but as the book illustrates there was no clear consensus on what exactly constituted bad womanhood.
