In colonial America, the system of "warning out" was distinctive to New England, a way for a community to regulate those to whom it would extend welfare. Robert Love's Warnings animates this nearly forgotten aspect of colonial life, richly detailing the moral and legal basis of the practice and the religious and humanistic vision of those who enforced it. Historians Cornelia H. Dayton and Sharon V. Salinger follow one otherwise obscure town clerk, Robert Love, as he walked through Boston's streets to tell sojourners, "in His Majesty's Name," that they were warned to depart the town in fourteen days. This declaration meant not that newcomers literally had to leave, but that they could not claim legal settlement or rely on town poor relief. Warned youths and adults could reside, work, marry, or buy a house in the city. If they became needy, their relief was paid for by the province treasurer. Warning thus functioned as a registration system, encouraging the flow of labor and protecting town coffers. Between 1765 and 1774, Robert Love warned four thousand itinerants, including youthful migrant workers, demobilized British soldiers, recently exiled Acadians, and women following the redcoats who occupied Boston in 1768. Appointed warner at age sixty-eight owing to his unusual capacity for remembering faces, Love kept meticulous records of the sojourners he spoke to, including where they lodged and whether they were lame, ragged, drunk, impudent, homeless, or begging. Through these documents, Dayton and Salinger reconstruct the biographies of travelers, exploring why so many people were on the move throughout the British Atlantic and why they came to Boston. With a fresh interpretation of the role that warning played in Boston's civic structure and street life, Robert Love's Warnings reveals the complex legal, social, and political landscape of New England in the decade before the Revolution.
Constructing Colonial People provides a new and comprehensive interpretation of how the United States attempted to transform Puerto Rico from a neglected backwater of the Spanish empire into one of its key props in establishing hegemony in the western hemisphere. The book looks at the formative three-and-one-half decades of U.S. colonial rule, when the colony's key institutions, economic structures, and legal doctrines were transformed. Policy papers, speeches, newspaper articles, and memoirs from the period inform the study with particular detail and insight. Cabán further examines the dynamics of U.S. expansionism during the Progressive Era and examines the normative and ideological constructions that were used to rationalize a campaign of territorial acquisition and colonial administration. Combining legal and social history, Bruce Mann explores the relationship between law and society from the mid-seventeenth century to the eve of the Revolution. Analyzing a sample of more than five thousand civil cases from the records of local courts in Connecticut, he shows how once-neighborly modes of disputing yielded to a legal system that treated neighbors and strangers alike. During the colonial period population growth, immigration, economic development, war, and religious revival transformed the nature and context of official and economic relations in Connecticut. Towns lost the insularity and homogeneity that made them the embodiment of community. Debt litigation was transformed from a communal model of disputing in which procedures were based on the individual disagreements to a system of mechanical rules that homogenized law. Pleading grew more technical, and the civil jury faded from predominance to comparative insignificance. Arbitration and church disciplinary proceedings, the usual alternatives to legal process, became more formal and legalistic and, ultimately, less communal. Using a computer-assisted analysis of court records and insights drawn from anthropology and sociology, Mann concludes that changes in the law and its applications were tied to the growing commercialization of the economy. They also can be attributed to the fledgling legal profession's approach to law as an autonomous system rather than as a communal process. These changes marked the advent of a legal system that valued predictability and uniformity of legal relations more than responsiveness to individual communities. Mann shows that by the eve of the Revolution colonial law had become less identified with community and more closely associated with society.
