This work reveals the true dimension of the African Charter through a systematic analysis of its real or apparent innovations and a detailed assessment of the commitments of the States parties. It also analyzes the effectiveness of the mechanism put in place to monitor compliance with those commitments, examining the practice of the African Commission on Human and Peoples’ Rights from its establishment in 1987. It incorporates major recent achievements in the field of the protection of human rights in Africa, including the creation of the African Court of Human and Peoples’ Rights and the establishment of the African Union. L'importance du droit de la mer n'est plus à démontrer au regard des problèmes actuels que constituent la surexploitation des stocks de poissons, les marées noires et l'état parfois inquiétant des navires. Depuis la consécration de la zone économique exclusive (ZEE) par la Convention des Nations Unies sur le droit de la mer de 1982, les Etats côtiers disposent en effet de droits importants sur cette zone maritime s'étendant au large jusqu'à une distance de 200 milles marins. Le présent ouvrage dresse un tableau de la pratique relative à la ZEE quelque deux décennies après la signature de la Convention des Nations Unies sur le droit de la mer, en tenant compte de la pratique des Etats et également de celle des organisations internationales et des ONG. The importance of the law of the sea has become self-evident in the light of current issues such as overexploitation of fisheries resources, oil sticks and unseaworthy ships. Since the establishment of the exclusive economic zone (EEZ) by the 1982 United Nations Convention on the Law of the Sea, coastal States have enjoyed important rights over this maritime zone, which extends 200 nautical miles from the coastline. This book takes stock of how practice has developed with respect to the EEZ some 20 years after the signature of the United Nations Convention on the Law of the Sea, on the basis of State practice and also the practice of international organizations and NGOs.
This study examines fisheries control issues at the national, regional and subregional level. It consists of two major international agreements: the FAO Compliance Agreement and the UN Fish Stocks Agreement. The study analyses and compares national legal systems and their governance of fisheries control. Existing and proposed regional and subregional agreements are identified, analysed and compared.
This volume reviews and critiques efforts to recast governance of marine fisheries on the basis of sustainability principles (e.g., precautionary and ecosystem approaches), with a focus on Canada’s transboundary fisheries management arrangements, and surveys international laws and policy developments governing transboundary fisheries.
