Taiwan’s modern legal system--quite different from those of both traditional China and the People’s Republic--has evolved since the advent of Japanese rule in 1895. Japan has gradually adopted Western law during the 19th-century and when it occupied Taiwan--a frontier society composed of Han Chinese settlers--its codes were instituted for the purpose of rapidly assimilating the Taiwanese people into Japanese society. Tay-sheng Wang’s comprehensive study lays a solid foundation for future analyses of Taiwanese law. It documents how Western traditions influenced the formation of Taiwan’s modern legal structure through the conduit of Japanese colonial rule and demonstrates the extent to which legal concepts diverged from the Chinese legal tradition and moved toward Western law.
This book presents a comprehensive account of the historical development of the Charismatic Movement in Taiwan, placing it within the context of Taiwan’s religious and political history. Judith C. P. Lin unearths invaluable sources of the Japan Apostolic Mission, the Full Gospel Business Men’s Fellowship International Formosa Chapter, and Jean Stone Willans’ short stay in Taiwan in 1968. Lin describes and analyzes how the efforts of 1970s charismatic missionaries in Taiwan—including Pearl Young, Nicholas Krushnisky, Donald Dale, Allen J. Swanson, and Ross Paterson—shaped the theological convictions of later Taiwanese charismatic leaders. She also explores significant developments in the Taiwanese Church which contributed to the gradual and widespread recognition of the Charismatic Movement in Taiwan from 1980 to 1995. The first is the historical framework of imperialism - until now widely applied by Western and Chinese scholars as an approach to the Christian evangelization movement in China. The theological aspect of the missionary action is seldom taken into account, nor is religion treated as an authentic human experience. In this volume two authors try to place the position of the Christian mission in its broader context. Scott Somers reflects on the changing image of the Japanese occupation in Taiwan, based on protestant missionary sources; Koen De Ridder discusses the early diplomatic contacts between China and Belgium and the position of the Belgian missionaries. A second problem dealt with is that of the native Christians. While Jessie Lutz attempts to sketch a profile of the Chinese Protestant evangelizers, Jean-Paul Wiest focuses his attention on the Roman Catholics among the Chinese Hakka minority. Gary Tiedemann explains the material, spiritual and political incentives for conversion among the inhabitants of North China, paying special attention to the socio-political profile of the converts. In the contribution of Ann Heylen we return to Taiwan, where we are offered a better understanding of the Protestant contribution to the study of the Min language. Finally, Karel Steenbrink describes the changing religious affiliation of assimilated Chinese in Indonesia during the period 1900-1942.
This volume analyzes what is arguably the single most important aspect of cultural and political change in Taiwan over the past quarter-century: the trend toward 'indigenization' (bentuhua). This book presents a comprehensive account of past and present efforts to introduce the jury system in Japan. Four legal reforms are documented and assessed: the implementation of the bureaucratic and all-judge special jury systems in the 1870s, the introduction of the all-layperson jury in the late 1920s, the transplantation of the Anglo-American-style jury system to Okinawa under the U.S. Occupation, and the implementation of the mixed-court lay judge (saiban’in) system in 2009. While being primarily interested in the related case studies, the book also discusses the instances when the idea of introducing trial by jury was rejected at different times in Japan’s history. Why does legal reform happen? What are the determinants of success and failure of a reform effort? What are the prospects of the saiban’in system to function effectively in Japan? This book offers important insights on the questions that lie at the core of the law and society debate and are highly relevant for understanding contemporary Japan and its recent and distant past.
China has many religions. But rituals of local temples are none of these. They celebrate many gods and their powers to respond. Gods are invited as welcome guests by appropriate rituals of welcome and communication. Other rituals pacify ghosts and harmful powers.
