What was Adam Smith’s intellectual laboratory? How did his economic theory take shape? Were his metaphors of order only residual and ornamental expressions? This book answers these questions by analyzing the formation of the concepts of market and social order in Adam Smith’s work, by considering various aspects of his approach. It analyzes how metaphors and pre-analytical concepts influenced Smith’s theory. In line with studies that deal with the cognitive role of metaphors in science, this book suggests that in Smith’s work metaphors provided a framework, on which basis the theory subsequently developed. Therefore, as such they were part of that intellectual process which made possible the formation of structured concepts. The content and scope of the book permits a more comprehensive interpretation of Smith’s thought, in which many aspects of his work are taken into consideration in order to explain a crucial problem for Smith: the nature and causes of social and economic order. The book also shows that in general, formation of theories is a complex process that includes pre-analytical views as non-residual parts of inquiry.

The most basic assertions about our bodies--that they are ours and distinguish us from each other, that they are private and have boundaries, races, and genders--are all political theories, constructed in legal texts for political purposes. So argues Alan Hyde in this first account of the body in legal thought. Hyde demonstrates that none of the constructions of the body in legal texts are universal truths that rest solely on body experience. Drawing on an array of fascinating case material, he shows that legal texts can construct all kinds of bodies, including those that are not owned at all, that are just like other bodies, that are public, open, and accessible to others. Further, the language, images, and metaphors of the body in legal texts can often convince us of positions to which we would not assent as a matter of political theory. Through analysis of legal texts, Hyde shows, for example, how law's words construct the vagina as the most searchable body part; the penis as entirely under mental control; the bone marrow that need not be shared with a half-sibling who will die without it; and urine that must be surrendered for drug testing in rituals of national purification. What is the body? How was it culturally constructed, conceived, and cultivated before and after the advent of rationalism and modern science? This interdisciplinary study elaborates a cultural genealogy of the body and its legacies to modernity by tracing its crucial redefinition from a live anatomical entity to disembodied, mechanical and virtual analogs. The study ranges from Baroque, pre-Cartesian interpretations of body and embodiment, to the Cartesian elaboration of ontological difference and mind-body dualism, and it concludes with the parodic and violent aftermath of this legacy to the French Enlightenment. The examination of sexuality and the emergence of sexual difference as a dominant mode of embodiment are central to the book's overall design.
