Water security threats arising from inadequate access to water for sustaining ecosystems, livelihoods, human well-being and socio-economic development has gained increasing attention over the past decades all over the world, but especially in international river basins shared by two or more states. In the Aral Sea basin, shared by Afghanistan and five post-Soviet republics of Central Asia – Kazakhstan, Kyrgyzstan, Tajikistan, Turkmenistan and Uzbekistan - water security issues are extremely pressing due to heavy reliance on, and competition over, shared waters. Promoting Transboundary Water Security in the Aral Sea Basin through International Law addresses the current gap in the literature by moving beyond the static identification of treaties and norms to examine how these treaties and norms can work for water security in practice. Water plays a key role in addressing the most pressing global challenges of our time, including climate change adaptation, food and energy security, environmental sustainability and the promotion of peace and stability. This comprehensive handbook explores the pivotal place of law and policy in efforts to ensure that water enables positive responses to these challenges and provides a basis for sound governance. The book reveals that significant progress has been made in recent decades to strengthen the governance of water resource management at different scales, including helping to address international and sub-national conflicts over transboundary water resources. It demonstrates that ‘effective’ laws and policies are fundamental drivers for the safe, equitable and sustainable utilization of water. However, it is also shown that what might constitute an effective law or policy related to water resources management is still hotly debated. The world’s freshwater supplies are increasingly threatened by rapidly increasing demand and the impacts of global climate change, but current approaches to transboundary water management are unsustainable and may threaten future global stability and international security. The absence of law in attempts to address this issue highlights the necessity for further understanding from the legal perspective. This book provides a fresh conceptualisation of water security, developing an operational methodology for identifying the four core elements of water security which must be addressed by international law: availability; access; adaptability; and ambit. The analysis of the legal framework of transboundary freshwater management based on this contemporary understanding of water security reveals the challenges and shortcomings of the current legal regime. In order to address these shortcomings, the present mindset of prevailing rigidity and state-centrism is challenged by examining how international legal instruments could be crafted to advance a more flexible and common approach towards transboundary water interaction. The concept of considering water security as a matter of ‘regional common concern’ is introduced to help international law play a more prominent role in addressing the challenges of global water insecurity. Ways for implementing such an approach are proposed and analysed by looking at international hydropolitics in Himalayan Asia. The book analyses transboundary water interaction as a ‘case study’ for advancing public international law in order to fulfil its responsibility of promoting international peace and security.
What are the rules of international water law that govern the use of the transboundary aquifers shared by Palestine and Israel? This book addresses this issue through an interdisciplinary approach, identifying first the special problems tied to the management of shared groundwater, and next critically analysing the applicable rules of international law. The innovative contribution of this work is its attempt to devise and suggest the means to implement a "progressive framework" for cooperation in the development and management of these shared waters. A solid review of hydro-politics, supported by current up to date information and rigorous examination of the evolution of the relevant rules of international law makes this book an important contribution to this very problematic area. Dr Fadia Diabes-Murad was awarded the Edberg Award 2005, presented at a special awards ceremony in Stockholm. Technological change is at the core of all major disruptions in human history, and revolutions, wars, and general development are regularly connected to some sort of technological change. However, not all development is beneficial. While technology has fueled great innovations and rapid development, the notion of sustainable development has gained prominence as we now experience serious social, economic, and environmental challenges. This book examines whether technology can be used to fix the very problems caused by technology, as the various chapters examine different aspects related to how technology has brought us where we are today (which some will say is the best place humanity’s been at according to a range of metrics), and whether technology helps or hinders us in our efforts to solve the challenges we currently face. As global climate change threatens to change radically both the political and physical climate with regard to water issues, so a reassessment of some of the fundamental principles of international water law is emerging. With the current body of international water law limited to customary principles and nascent treaty instruments, the potential for major transboundary water resources conflict is high. Nowhere is this more apparent than in the Nile River Basin. At about 6,825 km long, the Nile is the longest river in the world, sustaining the livelihoods of more than 180 million people in 11 riparian countries. And yet, the Nile River continues to flow without a binding cooperative management treaty or agreement. While the Nile Basin Cooperative Framework Agreement (CFA) may soon come into force, it lacks the support and participation of two of the largest players in the region, downstream Egypt and Sudan. Meanwhile, basin countries' interpretations of customary international water law highlight the inherent and predictable difficulties of reconciling the principles of equitable use and no significant harm. Considering the Nile River Basin's critical importance to the economic development of basin states, the absence of a binding cooperative management agreement places the Nile River Basin at risk of conflict and continued mismanagement. This chapter analyzes the legal status of Nile River Basin water allocations through the lens of contemporary international water law, a developing body of law struggling to resolve transboundary disputes such as those found in the Nile River Basin.
With "integrated water resources management" (IWRM) the current buzzword in international circles, the real question is: how to operationalise a truly multidisciplinary approach to the effective management of shared watercourses. Based largely on the actual experience of HELP (Hydrology for the Environment, Life and Policy), the overall aim of the book is to produce a series of case studies from around the world (from the Aral Sea to Zimbabwe) that demonstrate how the "gaps" between hydrology, water law and management are actually bridged in practice. Is hydrological data relevant and used in the formulation of national and international water law and policy? Cases cited include examples of where this has happened and been successful or unsuccessful and where this has not happened and led to problems. This will act as a guide to how future water laws and polices can be made more effective via the use of accurate and up to date hydrological information.
