Amendments to Regional Consistency Regulations - Final Rule (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Amendments to Regional Consistency Regulations - Final Rule (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 The Environmental Protection Agency (EPA) is promulgating revisions to its Regional Consistency regulations to more clearly address the implications of adverse federal court decisions that result from challenges to locally or regionally applicable actions. Specifically, the EPA is introducing a narrow procedural exception under which an EPA Regional office no longer needs to seek Headquarters concurrence to diverge from national policy in geographic areas covered by such an adverse court decision. The revisions will help to foster overall fairness and predictability regarding the scope and impact of judicial decisions under the Clean Air Act (CAA or Act). Revisions to the General Conformity Regulations - Final Rule (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Revisions to the General Conformity Regulations - Final Rule (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 The EPA is revising its regulations relating to the Clean Air Act (CAA) requirement that Federal actions conform to the appropriate State, tribal or Federal implementation plan (SIP, TIP, or FIP) for attaining clean air ("General Conformity"). EPA and other Federal agencies have gained experience with the implementation of the existing regulations, which were promulgated in 1993 (and underwent minor revisions in 2006), and have identified several issues with their implementation. In addition, in 2004, EPA issued regulations to implement the revised ozone national ambient air quality standards (NAAQS) and in 2007 issued regulations to implement the new fine particulate matter standard. State and other air quality agencies are in the process of developing revised plans to attain the new standards and the revisions to the General Conformity Regulations will be helpful to the State, Tribe, and local agencies in developing, and Federal agencies in commenting, on the proposed SIPs revisions. This rule revision will also facilitate Federal agency compliance with conforming its activities to the SIPs thereby preventing violations of the NAAQS. This rule revision provides for a timely and effective process for Federal agencies and States and Tribes to ensure Federal activities are incorporated in these SIPs. Where that is not possible, it provides an efficient and effective process for Federal agencies to ensure their actions do not cause or contribute to a violation of the NAAQS or interfere with the purpose of a SIP, TIP or FIP to attain or maintain the NAAQS. Ambient Air Monitoring Regulations - Correcting and Other Amendments (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Ambient Air Monitoring Regulations - Correcting and Other Amendments (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 The EPA is taking direct final action on "Ambient Air Monitoring Regulations: Correcting and Other Amendments" to correct and clarify parts of a recent final rule published on October 17, 2006, that amended the ambient air monitoring requirements for criteria pollutants. These errors included several instances where the wording in the preamble and regulatory text were not completely consistent, several regulatory text passages that contained some imprecise language, two instances of regulatory text omission, an outdated address reference, and numerous publication errors in tables and equations. EPA is also amending the monitoring rule to allow EPA Regional Administrators to approve departures from the minimum number of PM 10 monitors otherwise specified in the rule. Final Authorization of State-initiated Changes - Texas (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Final Authorization of State-initiated Changes - Texas (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 During a review of Texas' regulations, the EPA identified a variety of State-initiated changes to its hazardous waste program under the Resource Conservation and Recovery Act (RCRA). We have determined that these changes are minor and satisfy all requirements needed to qualify for Final authorization and are authorizing the State-initiated changes through this Direct Final action. Transportation Conformity Rule Restructuring Amendments (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Transportation Conformity Rule Restructuring Amendments (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 EPA is amending the transportation conformity rule to finalize provisions that were proposed on August 13, 2010. These amendments restructure several sections of the transportation conformity rule so that they apply to any new or revised National Ambient Air Quality Standards. EPA is also finalizing several clarifications to improve implementation of the rule. EPA is not taking a final action at this time on the proposal that areas analyze a near-term analysis year when using the budget test. Revisions to Federal Implementation Plans to Reduce Interstate Transport of Fine Particulate Matter and Ozone - Final Rule (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Revisions to Federal Implementation Plans to Reduce Interstate Transport of Fine Particulate Matter and Ozone - Final Rule (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 EPA is finalizing revisions to the Transport Rule that was published on August 8, 2011 (76 FR 48208). These revisions address discrepancies in unit-specific modeling assumptions that affect the proper calculation of Transport Rule state budgets and assurance levels in Florida, Louisiana, Michigan, Mississippi, Nebraska, New Jersey, New York, Texas, and Wisconsin, as well as new unit set-asides in Arkansas and Texas. EPA is also finalizing allowance allocation revisions to specific units covered by certain consent decrees that restrict the use of those allowances. The resulting budgets maintain substantial emission reductions from historic levels and are consistent with the final Transport Rule's methodology for defining significant contribution and interference with maintenance. Final Rule Interpreting the Scope of Certain Monitoring Requirements for State and Federal Operating Permits Programs (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Final Rule Interpreting the Scope of Certain Monitoring Requirements for State and Federal Operating Permits Programs (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 The purpose of this action is to finalize interpretation of certain existing federal air program operating permits regulations. We proposed an interpretation of these rules on June 2, 2006, and requested comment. This final interpretation responds to the comments we received. The final interpretation is that the plain language and structure of certain sections of the operating permits regulations do not provide an independent basis for requiring or authorizing review and enhancement of existing monitoring in title V permits. We believe that other rules establish a basis for such review and enhancement. Such other rules include the monitoring requirements in certain other sections of the federal operating permits regulations (i.e., periodic monitoring), existing federal air pollution control standards, and regulations implementing State requirements to meet the ambient air quality standards.
