Este libro es uno de los primeros en España, y seguramente en Europa, en analizar de manera profunda y detallada la incidencia de la regulación actual de la firma electrónica en los contratos digitales entre particulares. De una parte, el presente estudio de investigación tiene por objeto examinar la evolución y el marco legal actual de esta novedosa y, a la vez, ya consolidada institución dentro de nuestro ordenamiento jurídico, nacional y comunitario: la firma electrónica, esencial servicio de confianza que adquiere una renovada visión como consecuencia de la entrada en vigor del Reglamento (UE) nº 910/2014 del Parlamento Europeo y del Consejo, de 23 de julio de 2014, relativo a la identificación electrónica y los servicios de confianza para las transacciones electrónicas en el mercado interior, así como su normativa de desarrollo. Esta normativa constituirá el marco legal fundamental en el ámbito de la Unión Europea tras la derogación que efectúa de la Directiva 1999/93/CE del Parlamento Europeo y del Consejo, de 13 de diciembre de 1999, estableciendo un escenario regulatorio uniforme para la firma electrónica en todos los Estados miembros y consolidando una influencia decisiva a lo largo y ancho del panorama internacional extracomunitario. De otra parte, busca ofrecer al lector una profunda reflexión en torno a los aspectos más relevantes de esta disciplina, pronunciándose de un modo claro sobre la fuerza de la firma electrónica como medio de prueba en los procedimientos de contratación electrónica y tratando de subsanar la antinomia legislativa existente respecto de la controvertida naturaleza del documento electrónico. Sin duda, un libro obligatorio para todos aquellos estudiosos que quieran profundizar en un campo fundamental en el ámbito jurídico global.
La firma electrónica es un instrumento tecnológico que, con plena seguridad, permite a los sujetos identificarse y manifestar su consentimiento en las relaciones articuladas a través de redes telemáticas. No obstante, esta solución técnica ha suscitado significativas incógnitas tales como el valor jurídico de este tipo de firma o el régimen legal de los prestadores de servicios de certificación que hacen posible este instrumento. Con todo, las cuestiones precedentes no son las únicas. El contrato que vincula al firmante y al emisor de la firma -el desconocido contrato de certificación electrónico- es otra fuente de interrogantes que exige un estudio exhaustivo. Por ello, no es de extrañar que, entre otros muchos aspectos, cuestiones tales como la propia naturaleza y el contenido del contrato, la controvertida figura de los certificados o el propio régimen de responsabilidad al que se encuentran sometidas las partes sean objeto de estudio en estas páginas. No en vano, dar respuesta tanto a las ya citadas incógnitas iniciales como a las derivadas del análisis del mencionado contrato es la finalidad de esta obra.
